TERMS OF USE Legal Council Seller has the right and has been advised to seek legal council regarding any and all documents regarding the listing and sale of said property. Any contradicting comments and or terms on this addendum supersede the listing contract. This is a limited service listing agreement. Listing Broker and or listing agent are acting as a Seller's Agent with limited services only. The property will be listed on your Multiple Listing Service as well as www.realtor.com, www.dougbaird. com and any other sites that may be associated sites. Start Up And Prossessing Fee A fee $200.00 for up to 6 months or $350 for a for up to 12 months, in addition to a $50.00 start up fee is to be paid in advance. Payment is to be made out to Grand Rapids Realty. If the listing contract expires seller may choose to renew the listing under the same terms. No Extensions will be permitted beyond the original contract date will be permitted. Property Showings All showings will be arranged and scheduled directly through seller. Any feedback, follow up or results of said showings are to be seller’s responsibility. Seller must also provide a phone number for other Agents/Brokers to contact them regarding showings. Property Photos The first six photos are free. - These photos can either be e-mailed or supplied on a CD in JPEG format. (No Floppy Disk Will Be Accepted). All pictures must be renamed to identify what they refer to. All pictures must be resized to 640 x 400. If photos are not resized and or renamed, listing agent will resize only one front exterior photo and upload it to the MLS. Seller understands once the property is listed on the MLS, it may take up to 48 hours for all the photos to be displayed on the public side of the MLS. Seller may pay an additional $20.00 for additional photos. Limited Service Agreement Listing Agent/Broker is working as a Seller's Agent with limited service. No council or legal advice will be given to seller during the listing period. Seller understands that this programs is a "For Sale By Owner MLS Only Program". Seller also understands that the listing agent will not visit the property or meet with seller to list the property. This is a service for posting your home on the MLS only. Agents will be notified of the type of this type of listing and will be aware that they will be negotiating directly with you the seller. Offers To Purchase All offers submitted by Agents/Brokers must be submitted through listing office. If seller does not require listing Agent/Broker to negotiate on seller’s behalf, any and all offers received by listing agent for said property will be e-mailed directly to seller at no charge and seller will be responsible to negotiate any and all contracts to purchase directly with buyer and or their Agent/ Broker. Listing Agent/Broker’s liability is hear by waived if seller chooses not to involve the listing Agent/Broker during the negotiations See below for Optional Agent Involvement. Advertising Your Property Advertising and or marketing will be arranged by seller and is to be at seller’s expense. As a courtesy to buyers, seller agrees to advertise the home as listed in the MLS and the MLS number will be posted in the advertisement. Seller may also disclose to buyers they can buy direct from the seller if they are not working with an agent. All “For Sale Signs” and marketing tools are to be at seller’s expense. Corrections, Updates or Changes Once the home is posted on the MLS, listing agent will E-mail the MLS number to the seller. Any and all corrections, updated or changes made with in the first 7 days of the listing are free. All changes, corrections or updated made after the 7th day of the original listing date are to be at seller’s expense. ($10.00 per occurrence). Listing Price Seller is responsible for choosing the initial listing price. If seller requires a price reduction, a $10.00 fee will apply for each reduction and must be paid in advance. If seller wishes the Listing Agent/Listing Broker to provide a CMA (Competitive Market Analysis) once the home is listed a cost of $50.00 must be paid to Listing Agent/Listing Broker in advance. Said CMA will be provided to seller with in seven days of receipt of cleared payment. All price reductions must be submitted through listing agent and or Listing Broker and in writing on proper GRAR forms. These forms will be provided my listing office. Referring Buyers To Listing Agent/Broker Paragraph 10 in the listing contract requires seller to refer all inquires to this listing Broker/Agent. This paragraph is waived under this contract If seller produces there own buyer. Seller has the right to enter into a contract with a buyer that is not working with a licensed Agent/Broker and will not be responsible for any fees, commissions. Seller Agrees To Complete All Listing Documents A listing contract, seller’s disclosure, lead base paint disclosure, agency disclosure, residential data sheet, GRAR limited service addendum and Grand Rapids Realty For Sale By Owner MLS only limited service agreement. These documents will be provided by listing office at no charge. Moneys and Fees Paid In Advance Any and all moneys paid in advance are to be made payable to Grand Rapids Realty and are non-refundable. Checks written buy seller and accepted by Broker/Agent with insufficient funds to cover said check will result in a $100.00 penalty to be paid by seller to broker by means of a money order or certified funds. If seller fails to provide said funds, the broker reserves the right to withdraw the property from the GRAR MLS and the terms and dates of the listing contract will be in full force subsequently preventing the seller from selling property unless the entire brokerage fee as well and any penalties are paid in full. Selling Broker/Agent Compensation Seller must agree to pay a reasonable compensation/finder’s fee to a selling Broker if another Realtor/Broker provides a qualified buyer, an acceptable offer and can bring the transaction to a close. In the Grand Rapids area, 3% of the sale price and above is customary. However, the amount paid to selling Agent/Broker is seller’s choice. The amount of compensation must be established at time of listing and is to be paid only if the property sells and closes. Seller May Withdraw The Home From The Market At any time seller may remove the home from the market for a fee of $20.00 and understands that the original dates on the listing contract are enforceable should seller sell the property during the original listing dates. The status on the MLS will be changed from active to withdrawn and will no longer appear as available for sale on the MLS. Early Termination Of Contract If seller requires listing Agent or it’s Broker to accelerate the listing contract dates and change the listing status to Expired a fee of $50.00 is required and payable in advance to Grand Rapids Realty. Delivery Of Document Any and all contracts to list the property will be will be provided Via E-mail to seller and returned to Listing Agent Via USPS with the start up fee. Changes to this contract Seller may not write in, change or negotiate their own terms into this contract. Pending And Closing The Sale Seller agrees to notify listing agent when an accepted offer has been executed and when transaction closes. Listing Comments It is the seller’s responsibility to provide the listing comments to the listing broker in a “Word” or “Note Pad” format. Although the data sheet you will be provided includes a space for you to hand write the comments, no hand written comments will be accepted. The listing comments can be e-mailed or saved to a CD along with the photos. Room Sizes Room sizes mentioned on the listing data sheet are required to submit your listing on the MLS. At Close Fees Seller understands that their will be no fees paid to Listing Broker at time of close. Any and all fees for service under this program are to be paid in advance. Seller also understands that with every Real Estate Transactions seller is required to pay customary fees such as Title Insurance, Closing Fee, Recording Fee Etc... For Sale Sign Seller has been advised to remove the “For Sale By Owner Sign” when another Agent/Broker shows the property. Agents/Brokers may or may not become discouraged in moving forward to a purchase when they find a “For Sale By Owner Sign” in the yard. (Optional) Seller May Sell The Property By Owner Seller has the right to sell the property on their own to their own buyer and avoid paying any additional Brokerage Fees to a Selling Broker. Seller has been advised to avoid trying to “by pass” a Selling/Broker if said buyer is currently working with an Agent/Broker under a buyer agency contract. Doing so may result in paying a commission later if the selling Agent/Broker pursues a commission in a Court Of Law. Property is Sold By Listing Agent/Broker Any offer written by listing Agent/Broker and accepted by the property owner/seller the agreed commission on the listing contract to selling Agent/Broker is to be paid. Seller also understands that if this occurs, the Brokerage will become a dual agent. Full Service Program Seller has been made aware that full service programs are available and has opted out of listing under a full service program at this time. Offer Purchase Service By Owner (Optional) Seller is aware that a service to write an offer for buyer and seller by Listing Agent/Broker is available. Upon buyer and seller agreeing on a price and terms and if seller requires listing agent to write and execute an offer on said property, Listing Agent/Broker, buyer and seller will physically meet at seller’s property to do so. A fee of $250.00 payable at time of Listing Agent/Broker meeting with buyer and seller must be paid. If sale does not close, moneys paid in advance are non refundable. Assisting In The Closing Process By Owner (Optional) If seller requires listing Agent/Broker to become involved in negotiating the transaction on seller’s behalf an optional fee of $250.00 will be charged at time of offer to purchase presentation. A separate fee is to be paid for each transaction. If seller uses this option and a sale to purchase does not close or an agreement is not made, no refunds will be made on money’s paid in advance to the Listing Agent/Broker. OR Assisting In Negotiating And The Closing Process By Owner (Optional) Seller may pay a one time fee of $250.00 in advance to assist with any offers, negotiate on seller's behalf, and assist the seller to close. Seller may also contact listing agent during the listing period for assistance and advice. Listing on any other MLS other than the Grand Rapids MLS (GRAR) All listing will be placed on the Grand Rapids Association of Realtors MLS. If you would like your property listed on any other MLS, the cost is $100.00 per MLS. Example - If you own a home in the Jackson area and you would like it posted on the Jackson MLS, the cost is an additional $100.00. The reason for this is this. I am not a member of any other MLS other that the Grand Rapids Association of Realtors. I must pay each MLS other than the Grand Rapids Association of Realtors a fee to place your property on your local MLS. Multiple MLS Listing Any properties listed on any MLS System in addition to the Grand Rapids MLS System will have up to 12 photos uploaded. The additional photo fee $20.00 and the photo resizing fee of $10.00 will be waived. These listings will also be posted on Realtor.com as well as several other web sites for free. Arranging And Delivery Of Paperwork. Seller understands that the Agent/Broker will not meet with the seller face to face to discuss and execute the paperwork to list the home on the MLS. All paperwork will be delivered to seller via the Internet and returned to agent/Broker VIA the mail. If seller requires Agent to meet face to face in any form weather it be at Broker's office, seller's home or any other meeting place an additional $100.00 fee must be paid prior to meeting.
