TERMS OF USE

Legal Council - Seller has the right and has been advised to seek legal council regarding any and all documents
regarding the listing and sale of said property. Any contradicting comments and or terms in the statement supersede the
listing contract. This is a limited service listing agreement. Listing Broker and or listing agent are acting as a Seller's
Agent with limited services only. The property will be listed on the Multiple Listing Service as well as www.realtor.com,  
www.dougbaird.com and any other sites that may be associated sites.

Start Up Fees - A non refundable fee of $25.00 is to paid in advance and must be received by the listing agent before
the documents are prepared and sent to the property owner/seller. The balance of $174.00 is to be paid to at the time
the completed paperwork is returned to listing agent.  

Length Of Listing - Seller may list their property for up to one year under this program. If seller chooses to list for less
than one year and wishes to extend the contract to a full year a $20.00 fee will be charged for each extension. If the
contract expires and the seller wishes to renew, all fees and charges will be as though it was a new contract will apply.
Listing office will not notify seller when the contract is close to expiring or once the contract has expired.

Property Showings - All showings will be arranged and scheduled directly through seller. Any feedback, follow up or
results of said showings are to be seller’s responsibility. Seller must also provide a phone number for other
Agents/Brokers to contact them regarding showings.

Property Photos - The first twenty four photos are free - These photos can either be e-mailed or supplied on a CD in
JPEG format ONLY. (No Floppy Disk Will Be Accepted). All pictures must be renamed to identify what they refer to. In
addition all photos must be numbered in the order the seller would like them posted. The front photo must always be the
first photo. Seller understands once the property is listed on the MLS, it may take up to 48 hours for all the photos to be
displayed on the public side of the MLS. Any photo changes or photo additions during the listing period and after the 7th
day of the initial listing date will a $5.00 charge per photo.

Limited Service Agreement - Listing Agent/Broker is working as a Seller's Agent with limited service.  No council or
legal advice will be given to seller during the listing period. Seller understands that this program is a "For Sale By Owner
MLS Only Program". Seller also understands that the listing agent does not normally visit the property or meet with seller
to execute the paperwork.  All paperwork will be delivered to seller via the Internet and returned to agent/Broker VIA the
mail. If seller requires the agent to meet face to face in any form whether it be at Broker's office, seller's home or any
other meeting place an additional $100.00 fee must be paid at time of meeting.

Offers To Purchase - All offers submitted by Agents/Brokers are to be presented directly to the property owner. Any
and all completed offers must be provided to listing company. Grand Rapids Realty

Advertising Your Property - Advertising and or marketing will be arranged by seller and is to be at seller’s expense.
As a courtesy to buyers, seller agrees to advertise the home as listed in the MLS and the MLS number will be posted in
the advertisement. Seller may also disclose to buyers they can buy direct from the seller if they are not working with an
agent. All “For Sale Signs” and marketing tools are to be at seller’s expense.

Corrections, Updates or Changes - Once the home is posted on the MLS, the listing agent will E-mail the MLS
number to the seller. Any and all corrections, updated or changes made with in the first 7 days of the listing are free. All
changes, corrections or updated made after the 7th day of the original listing date are to be at seller’s expense. ($20.00
per occurrence and per change).

Listing Price - Seller is responsible for choosing the initial listing price.  If seller requires a price reduction, a $20.00 fee
will apply for each reduction and must be paid in advance. If seller wishes the Listing Agent/Listing Broker to provide a
CMA (Competitive Market Analysis) once the home is listed a cost of $50.00 must be paid to Listing Agent/Listing Broker
in advance. Said CMA will be provided to seller with in seven days of receipt of cleared payment. All price reductions
must be submitted through listing agent and or Listing Broker and in writing on proper MLS forms. These forms will be
provided my listing office at no cost.

Referring Buyers To Listing Agent/Broker -The standard MLS listing contracts requires the seller to refer all inquires
to this listing Broker/Agent. This is waived under this contract If seller produces there own buyer. Seller has the right to
enter into a contract with a buyer that is not working with a licensed Agent/Broker and will not be responsible for any
fees, commissions. Seller has the right to sell the property on their own to their own buyer and avoid paying any
additional Brokerage Fees to a Selling Broker. Seller has been advised to avoid trying to  “by pass” a Selling/Broker if
said buyer is currently working with an Agent/Broker under a buyer agency contract. Doing so may result in paying a
commission later if the selling Agent/Broker pursues a commission in a Court Of Law.

Seller Agrees To Complete All Listing Documents - A listing contract, seller’s disclosure, lead base paint disclosure,
agency disclosure, GRAR limited service addendum and Grand Rapids Realty For Sale By Owner MLS only limited
service agreement.

Moneys and Fees Paid In Advance - Any and all moneys paid in advance are to be made payable to Grand Rapids
Realty and are non-refundable. Checks written buy seller and accepted by Broker/Agent with insufficient funds to cover
said check will result in a $100.00 penalty to be paid by seller to broker by means of a money order or certified funds. If
seller fails to provide said funds, the broker reserves the right to withdraw the property from the MLS and the terms and
dates of the listing contract will be in full force subsequently preventing the seller from selling property unless the entire
brokerage fee as well and any penalties are paid in full.

Selling Broker/Agent Compensation - Seller must agree to pay a reasonable compensation/finder’s fee to a selling
Broker if another Realtor/Broker provides a qualified buyer, an acceptable offer and can bring the transaction to a close.
This fee must be agreed upon at time of listing. In the Grand Rapids area, 3% of the sale price and above is customary.
However, the amount paid to selling Agent/Broker is seller’s choice. The amount of compensation must be established at
time of listing and is to be paid only if the property sells and closes.

Seller May Expire The Home From The Market - At any time the seller may remove the home from the market for a
fee of $20.00 allowing the seller to pursue other agency or sales options.

Pending And Closing The Sale - By law all pending sales must be reported to the MLS with in 72 hours from the time
a purchase agreement is fully executed. Seller agrees to notify listing agent when an accepted offer has been executed
as well as when transaction closes. This is considered contract law. Failure to do so will be seller agrees to take all
responsibility for fines by the state or local government.

Sale Falls Through - If seller enters into a sales contract and the sale does not result in a closing and the listing status
must be changed from pending to current seller to pay a $20.00 fee. Any time that the home was removed from the MLS
due to a pending sale will not be credited to seller.

Listing Comments - It is the seller’s responsibility to provide the listing comments to the listing broker in a “Word,
Works, or Note Pad” format. No hand written comments will be accepted.  The listing comments can be e-mailed or
saved to a CD along with the photos.

At Close Fees - Seller understands that their will be no fees paid to Listing Broker at time of close. Any and all fees for
service under this program are to be paid in advance unless additional services are requested by seller and indicated
as being payable at close. Seller also understands that with every Real Estate transaction, seller is required to pay
customary fees such as Title Insurance, Closing Fee, Recording Fee Etc...

For Sale Sign - Seller has been advised to remove the “For Sale By Owner Sign” when another Agent/Broker shows
the property. Agents/Brokers may or may not become discouraged in moving forward to a purchase when they find a
“For Sale By Owner Sign” in the yard. (Optional) If seller requires the listing office to provide a for sale sign a fee of
$100.00 must be paid in advance.

Property is Sold By Listing Agent/Broker - Any offer written by listing Agent/Broker and accepted by the property
owner/seller the agreed commission on the listing contract to selling Agent/Broker is to be paid. Seller also understands
that if this occurs, the Brokerage may become a dual agent. This does not include offers written on seller's behalf. See
below.

(Optional) Offer Purchase Service By Owner (Optional) - Seller is aware that a service to write an offer for buyer
and seller by Listing Agent/Broker is available. Upon buyer and seller agreeing on a price and terms and if seller
requires listing agent to write and execute an offer on said property, Listing Agent/Broker, buyer and seller will physically
meet at seller’s property to do so.  A fee of $250.00 payable at time of Listing Agent/Broker meeting with buyer and
seller will be charged and $250.00 at time of close. If sale does not close, moneys paid in advance are non refundable.
Agent will be acting as a transaction coordinator.

(Optional) Assisting In The Closing Process By Owner (Optional) - If seller requires listing Agent/Broker to become
involved in negotiating the transaction on seller’s behalf an optional fee of $250.00 at time of presentation and $250.00
at time of close will be charged. The agent's agency status will be changed from a Seller's agent with limited service to a
seller's agent with full representation for this transaction only. If sale does not close or an agreement is not made, no
refunds will be made on money’s paid in advance to the Listing Agent/Broker.

(Optional) Available Full Service Programs (Optional) - Seller has been made aware that full service programs are
available and has opted out of listing under a full service program at this time.

Notice To Seller Regarding Short Sales
During the listing period if it is made known that the property requires a SHORT SALE to close the sale due to an impending foreclosure or the seller is not in a
position to accept an offer with out requiring negotiations with the bank for a lesser pay off on the amount due the bank, the commission is automatically 6% of
the sale price. Failure to disclose the need for a short sale or foreclosure to the listing office and on the seller's disclosure will result in the home being withdrawn
from the market. Also, if a short sale is required, you the seller agree to allow the Broker Grand Rapids Realty to become involved in the short sale process. It must
also be disclosed on the listing card of the conditions of the short sale. The initial fee seller paid at time of listing will be refunded to seller if the sale closes
under these conditions and is not to exceed $250.00. Also, the seller agrees to extend the listing contract at no charge to the seller to allow enough time for the
short sale process to be completed.

For Sale By Owner MLS Only  $199.00 For Up to One Year

This option allows you to sell your property on your own. If you sell it yourself, the commission to the selling Broker is waived.

You can post up to 24 interior and exterior pictures on the MLS and 4 on Realtor.com.

You pay me the listing agent $0.00 at close unless I bring a buyer to the table and the sale closes. In most cases other Brokers and
Buyers will call you directly for showing and with questions. In fact most buyer calls I get through the MLS will be referred directly to
you.

Your property will be posted on Realtor.com & Zillo.com as well as 10 to 15 other web sites.

With this program you can now compete with all of the listed properties in West Michigan.

The quality of buyers calls will increase dramatically. Less
"Rent To Own"& "Land Contract" calls and more I would like to buy calls.

You will now be advertising to over 10,000 agents in West Michigan on over 20 different Real Estate Boards. They will all know that you
are willing to work with them.

How do you get the process started?

First you must call me at 616-554-5796. Everything is done over the phone and Via E-Mail. Once you have
decided on this program you will need to choose a price and a length of listing. I will then prepare the
necessary documents, scan them and E-mail them to you in a PDF format. Once you have received to you
must complete them and return them Via the US Postal Service. The check must be included and is to be
made out to Grand Rapids Realty. If you would like additional services see the bottom of this page for a
menu and a list of fees for these services. You may at any time send the description of the home (the
listing card comments) and the pictures via E-mail. Be sure you send the listing comments in a Word,
Works or Word Pad format.

Note
An up front fee of $25.00 must be paid in advance before any documents are to be prepared. This $25.00 up
front fee will be deducted from the total of $199.00 leaving a balance owed of $174.00 at the time the
paperwork is returned to the Listing Office. By doing this all the necessary documents accept for the
seller's disclosure will be completed for you.
OR
If you wish to complete the paperwork on your own without my assistance, the documents can be e-mailed
to you for the most part uncompleted. You will not be allowed to black out any preprinted verbiage or
change any of the terms of the contracts. The total fee of $199.00 will remain the same regardless if you
choose to complete the paperwork your self or not.

Once I have received all the documents I will contact you set up a phone appointment to complete the
posting to the MLS. Once the phone appointment is complete  your listing will be posted on the MLS and
you will be provided with your new MLS number.  

This program is strictly a "For Sale By Owner MLS Program"/
Limited Service Program. You as a seller are
responsible for any negotiations with agents and buyers. If during the contract period, if you find you are
overwhelmed you can upgrade to a full service program during the listing period for a fee.

All offers will be presented directly to you. If and when you come to an agreement, you will be required to
provided Grand Rapids Realty a copy of the fully executed purchase agreement so that the sale can be
reported as pending.  Once the transaction has closed you must contact Grand Rapids Realty so that the
sale can be reported as closed. Their is no fee for this.

Just a couple of things to keep in mind -

1. Your phone number will appear on the MLS for agents to call you, however, MLS rules will not allow
agents to place seller's phone numbers in such a place that the public can see.

2. Your home will be listed on the MLS system as soon as we complete the phone meeting to post your
home, however, it may take some time to reach all the web sites that all listed properties are listed on.
